Questions to ask a DWI Attorney
Questions you should ask your DWI Attorney

How much experience do you have with DWI cases?

This is important, because DWI litigation is one of the most complicated areas of criminal law. Your lawyer should have thorough knowledge of the law surrounding these types of cases. Additionally, there is absolutely no substitute for trial experience. At The Wilder Firm, we’ve tried hundreds of cases with an extremely high success rate. Your lawyer should have a proven record of winning.

How much of your practice is devoted to handling DWI cases?

To find a lawyer who stays on top of trends, new laws, and what’s going on in the courts, you’ll need to look for one who spends most of his time handling DWI cases. He should focus his continuing legal education (CLE) hours on DWI-specific seminars. Finally, many of the best DWI lawyers are members of the National College of DUI Defense.

How many DWI cases have you tried?

There’s no set number for your ideal attorney, but again: if the lawyer hasn’t focused most of his practice on DWI cases, he probably doesn’t have enough experience to win your case.

How many of your cases plead guilty?

Many lawyers advise their clients to plead guilty, regardless of circumstances. At The Wilder Firm, the last thing we want is to see you plead guilty to a DWI charge. We treat this as a last resort.

Do you own copies of the “Texas Drunk Driving Law” and “Drinking/Driving Litigation Criminal and Civil” textbooks?

These are educational works on the changing nature of DWI laws, designed to assist attorneys in improving their skills. These two books are generally considered essential resources in DWI defense, and any serious lawyer should have a copy of both.

Are you familiar with the breath test machine used in Texas?

To a true DWI defense attorney, a failed breath test in no way means you’ll be found guilty of drunk driving. It’s key for a lawyer to understand how the breath test machine works, how the body absorbs and removes alcohol, and the philosophy behind breath testing.

Are you skilled in the proper administration of Standardized Field Sobriety Tests?

Many DWI prosecutions involve the results of field sobriety tests. For these tests to be scientifically reliable, they must be administered in the standardized manner every single time. If the test is slightly off, the results may not be reliable.

Will you handle my license suspension case in addition to my DWI charge?

A DWI arrest actually results in two different cases: the DWI itself, and the hearing on the suspension of your drivers’ license. Many DWI attorneys don’t handle license suspension hearings. For your convenience, you may want to find an attorney who will handle both.

Will you handle all aspects of my case?

Some lawyers overload themselves with cases, only to have friends or associates handle important aspects of your case. These associates may not be as highly trained as the lawyer you initially hired. If you hire us, we personally handle all aspects of your case.

What will this cost me?

As the saying goes, “Good lawyers aren’t cheap and cheap lawyers aren’t good!” While this isn’t always the case, it’s true that the lawyers with the lowest fees are often the least experienced. This could cost you more in the long run, since an inexperienced lawyer could get you convicted – which is more expensive than any lawyer out there.
